The U.S. government regulates handling of hazardous materials and hazardous waste under U.S. EPA’s Resource Conservation and Recovery Act (RCRA).

RCRA defines hazardous waste as materials improperly managed that “poses a serious threat to human health and the environment.”

Facilities regulated by Title 40 Code of Federal Regulations Parts 264 and 265 and RCRA must provide training. OSHA includes facilities and workers who are required to respond to workplace emergencies when there is potential for exposure to hazardous materials.

The training curriculum guide found in 29 CFR 1910.120(e) offers the HAZWOPER 40 criteria that “student is or will be involved in work where chemical exposures are likely and that the student possesses the skills necessary to perform the work.”
